- Account Manager. Each existing customer of EQ that has received a log on must designate an account manager. The account manager is responsible for telling EQ what level of access various members of customer's personnel will have on the EQ website. For example, some customer personnel may have authority to access customer reports while others may have authority only to sign and send documents electronically to EQ. Customer is responsible for ensuring that all logons and passwords are current and remain confidential. Customer acknowledges and agrees that EQ shall assume, without any independent investigation, that the EQ website access authority communicated to EQ by the account manager is valid and current. Therefore, each customer must advise EQ promptly of any additions, deletions or other changes in each desired access authority to the EQ website.
- Third Party Certifications. EQ does not accept third party certifications.
- Errors and Corrections. EQ does not represent or warrant that the Web Site will be error-free, free of viruses or other harmful components, or that defects will be corrected. EQ does not warrant or represent that the information available on or through the Web Site will be current, accurate, complete, timely, or otherwise reliable. EQ may make improvements and/or changes to its features, functionality or content at any time.
- Third Party Content. Third party content may appear on this Web Site or may be accessible via links from this Web Site. EQ is not responsible for and assumes no liability for any mistakes, misstatements of law, defamation, slander, libel, omissions, falsehood, obscenity, pornography or profanity in the statements, opinions, representations or any other form of content contained in any third party content appearing on the Web Site. You understand that the information and opinions in the third party content is neither endorsed by nor does it reflect the belief of EQ.
- Disclaimer. The web site is provided on an "as is" basis. EQ expressly disclaims all warranties, including the warranties of merchantability, fitness for a particular purpose and non-infringement. - Limitation Of Liability. EQ shall not be liable for any loss, injury, claim, liability, or damage of any kind resulting from your use of the web site. EQ shall not be liable for any special, direct, indirect, incidental, or consequential damages of any kind whatsoever (including, without limitation, attorneys' fees) in any way due to, resulting from, or arising in connection with the use of or inability to use the web site or the content. To the extent the foregoing limitation of liability is prohibited, EQ's sole obligation to you for damages shall be limited to $100.00.
- Remedies for Violations. EQ reserves the right to seek all remedies available at law and in equity for violations of these Terms and Conditions of Use, including but not limited to the right to block access to parts or all of EQ's Web Site.
- Governing Law and Jurisdiction. The Terms and Conditions of Use are governed by and construed in accordance with the laws of the State of Michigan irrespective of its choice of law provisions.
- Severability of Provisions. These Terms and Conditions of Use incorporate by reference any notices contained on the Web Site and, together with the Security and Privacy Policy of EQ constitute the entire agreement with respect to access to and use of the EQ Web Site. If any provision of these Terms and Conditions of Use is unlawful, void or unenforceable, then that provision shall be deemed severable from the remaining provisions and shall not affect their validity and enforceability.
- Changes to Terms and Conditions. EQ reserves the right to make modification to these terms and conditions at any time. Customers are urged to review these terms and conditions each time that they visit this portion of the EQ website because the terms and conditions are binding on EQ customers. The date of the most recent update to the terms and conditions will always be posted. If you no longer wish to continue doing business with EQ electronically, all you have to do is stop transmitting information electronically and make sure that the authority and access of customer provided to EQ by customer's account manager are updated to reflect this change. Continued use of this portion of the EQ website signifies your continued agreement to be bound by these terms and conditions.
Security and Privacy
Our Commitment to Privacy. The privacy of EQ customers is important to us. We want you to know what type of information we collect from you and how we use it.
Our Web Site tracks certain information about the visits to our Web Site. For example, we compile statistics that show the numbers and frequency of visitors to our Web Site and its individual pages. These aggregated statistics are used internally to improve our Web Site and for product development and customer satisfaction survey purposes.
In a few areas on our Web Site, we may ask you to provide information that will enable us to verify whether you are entitled to transmit certain information to us electronically, or access and use certain information, materials and services available from our Web Site. Except in the specific case of sharing information in order to serve you better, EQ will not share your personal information with other entities.
